TERMS AND PRIVACY POLICY

1. The Portal

1.1 This website portal located at the url www.returntoit.co.nz and www.returntoit.mbie.govt.nz (“Portal”) is operated by Ice Professionals Limited (“ICE”) on behalf of the Ministry of Business, Innovation and Employment (“MBIE”).

1.2 References to “we” in these Terms and Privacy Policy are references to ICE unless specifically stated. References to “you” and “your” are references to users of the Portal.

2. Registering/Applying for the Programme

2.1 The Portal offers the ability for applicants to register on ICE’s database and apply for job opportunities with the organisations participating in MBIE’s Return to IT pilot programme (“the Programme”). All information provided by you as part of this service is held by ICE strictly in accordance with ICE’s Privacy Policy below, and is also collected, managed, stored, archived, destroyed under MBIE’s Privacy Impact Assessment Framework, in accordance with the Office of the Privacy Commissioner’s 12 Privacy Principles.

2.2 You must be over 18 to participate in the Programme and use the Portal

2.3 When you upload your details to this Portal ICE will screen you for suitability for the job opportunities available within the Programme. However, by uploading your details to this Portal neither ICE nor MBIE make any promise or guarantee that you will be selected for any of the available roles or that ICE or MBIE will find you work. Neither ICE nor MBIE accept liability arising from any inability on ICE’s part to find you work or any of the participating organisations parts to offer you work. ICE does not act as your agent and no legal relationship between you and ICE is created by registering on this Portal.

2.4 In the event that ICE determines at its discretion that there is a suitable job opportunity for you at a participating organisation), ICE will notify you via the email address provided by you on application to the Programme. Therefore, it is important that you check that the contact details you submit are accurate and that you update ICE of any changes, by emailing info@returntoIT.co.nz . You agree that ICE may send you information concerning job opportunities and to that address. You are entitled to unsubscribe from the Programme and if you do, you will no longer receive any further notification of job opportunities.

2.5 Neither ICE nor MBIE accept liability whatsoever: (a) In respect of the suitability of any job opportunities presented to you for consideration; or (b) In relation to any representations made by ICE or any of the participating organisations relating to such job opportunities. It shall be your responsibility to carry out your own independent due diligence in relation to any job opportunity presented to you before you accept an offer.

2.6 All information you provide must be accurate and complete. When accepting the terms of the Programme and Portal you declare that to the best of your knowledge the answers to the questions in the application are correct and you understand that if any false information is given, or any material fact suppressed, you may not be accepted into the Programme, or if you are employed, you may face disciplinary action including dismissal.

2.7 By registering for the Programme on the Portal, you agree to provide ICE and MBIE with follow-up information and answer confidential questions about the Programme including for the purposes of assisting with MBIE’s evaluation of the Programme.

3. Exclusion of warranties and liability

3.1 Whilst ICE has made every effort to ensure that the information provided on the Portal provides accurate information, the Portal is provided on an “as is” basis and the information provided is for general guidance only and does not constitute advice of any kind. You should obtain your own independent advice for any possible job opportunities presented to you.

3.2 Neither ICE or MBIE make any representations or warranties of any kind with respect to this Portal, its contents, its operation or availability. In particular, no representations are made or warranties given about the accuracy, completeness, or suitability for any purpose of the information and related graphics published on this Portal. The information contained in this site may contain technical inaccuracies, typographical errors or may be out of date. ICE’s and MBIE’s liability for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.

3.3 Neither ICE, nor MBIE, nor any of their Directors, shareholders, employees or contractors shall be liable for loss or damage arising out of or in connection with the use of this Portal or reliance on its contents. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. Notwithstanding this, none of the exclusions and limitations in the clause are intended to limit any rights you may have as a consumer under local law or other statutory rights which are not lawfully able to be excluded.

4. Intellectual property

4.1 ICE is the proprietor of the ICE Professionals trademark used on this website and you may not use it without ICE’s express permission.

4.2 MBIE is the proprietor of the MBIE trademark and Ministry for Women is the proprietor of the MfW trademark used on this website and you may not use either without MBIE’s or MfW’s express permission.

4.3 You may not use any trademark of any participating organisations represented on the Portal without their express permission.

4.4 Other than as described at clause 4.3 or otherwise indicated in the Portal, either ICE or MBIE are the owner or licensee of copyright existing in this Portal, its contents and images and no part of this Portal may be reproduced without the express permission of the copyright holder.

5. Privacy Policy

5.1 This Privacy Policy applies to personal information collected about you through the Portal. Information about you, your contact information, your work history and skills and computer or network information is collected by ICE. It is stored with a third party in the United States contracted by ICE to hold the information and will be:

  • a) therefore, subject to laws in both the United States and New Zealand jurisdictions relating to storage and access of personal information;
  • b) shared with the participating organisations in the Programme for the purposes of the selection of candidates for the job roles available;
  • c) used to contact you about potentially suitable job roles and matters relating to the Programme;
  • d) used by ICE, MBIE and external evaluators for the purposes of evaluating and reporting on the effectiveness of the Programme and publishing such findings;.

You have the right to ask for a copy of any personal information that is held about you, and to ask for it to be corrected if you think it is wrong. If you’d like to ask for a copy of your information, or to have it corrected, please contact ICE at info@returntoit.co.nz or send your request C/- , ICE Professionals Ltd, Level 7, 43 High Street, Auckland 1010. We will contact you within 30 days of receipt of your request.

6. New Zealand law

6.1 These Terms are subject to New Zealand law and you irrevocably accept the jurisdiction of the New Zealand Courts.

7. Variations

7.1 ICE and MBIE may agree to vary these Terms (including the Privacy Policy) from time to time. If the Terms change you will be sent a notification accompanied by a link to the amended Terms. Continued use of the Portal or participation in the Programme after any such notification is deemed to be your consent to the amended Terms.
